Terms of Service

PLEASE READ CAREFULLY: Section 12 contains a binding arbitration agreement and class-action waiver. Unless you opt out within 30 days, disputes will be resolved by individual arbitration, not in court or by class action.

1. Agreement

These Terms of Service (“Terms”) are an agreement between you and Nu Home Services(doing business as “Nu Home”), together with its parents, subsidiaries, and affiliates (“Nu Home,” “we,” “us”). By accessing our website, submitting a form, communicating with us, or using our services, you accept these Terms and our Privacy Policy. If you do not agree, do not use the site or services. You represent that you are at least 18 and, when requesting services for a property, that you own it or are authorized by the owner.

2. What we do

Nu Home designs home efficiency upgrades, identifies and files applicable rebate, incentive, and financing options, and coordinates installation performed by independent, licensed and insured local installation partners. Specific project terms — scope, price, schedule, financing, and workmanship warranties — are set out in the written proposal and installation agreement you sign for your project, which control over these Terms if they conflict.

3. Estimates, not guarantees

Savings figures on this site (including the calculator and any AI-generated insights) are good-faith estimates based on typical usage, published utility rates, and equipment ratings. Actual results depend on your home, weather, rates, and behavior, and are not guaranteed. Rebate and incentive programs are operated by third parties (states, municipalities, utilities), change frequently, and are subject to eligibility rules and available funding; final amounts are confirmed in writing during your project. Nothing on this site is financial, tax, or legal advice.

4. Communications, calls & texts (TCPA)

If you provide your phone number and consent, you authorize Nu Home and the local partner assigned to your project to call and text you about your project and our services, including via automated technology and prerecorded or artificial voice. Consent is not a condition of purchase. Message frequency varies; message and data rates may apply. You may revoke consent at any time by any reasonable method — reply STOP to texts, say so on a call, or email support@nuhomeservice.com — and we will honor revocations within ten (10) business days. Calls may be monitored or recorded as described in our Privacy Policy.

5. Electronic communications & signatures (E-SIGN)

You consent to receive agreements, disclosures, and notices from us electronically (by email, text, or through the site), and you agree that electronic signatures and records have the same force as ink and paper. You may withdraw this consent or request paper copies by contacting us, though doing so may limit our ability to serve you online. Keep your contact information current; notices sent to the address you provide are effective.

6. Your content & feedback

If you submit reviews, photos, testimonials, or feedback, you grant Nu Home a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, adapt, publish, and display that content in connection with our business (with attribution by first name and market unless you tell us otherwise), and you represent that you have the rights to grant it. We may use any suggestions or feedback without obligation to you. Do not submit content that is unlawful, infringing, or that includes another person's private information without permission.

7. Intellectual property

The Nu Home name, logo, “Nu Intelligence,” and all site content, design, software, and imagery are owned by Nu Home or its licensors and protected by law. We grant you a limited, revocable, non-transferable license to use the site for personal, non-commercial purposes. No other rights are granted.

8. Acceptable use

You agree not to: misuse or interfere with the site or its security; scrape, harvest, or bulk-extract data; submit false leads or impersonate others; reverse engineer our software; use the site to violate any law (including telemarketing and privacy laws); or use our content or marks without permission. We may suspend or terminate access for violations.

9. Third-party services

The site may link to or integrate third-party sites and services (utilities, program administrators, financing providers, mapping, analytics). We are not responsible for third parties' content, products, or practices; your use of them is governed by their terms.

10. Disclaimers

To the fullest extent permitted by law, the site and all content are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the site will be uninterrupted, timely, secure, or error-free. Nothing in this section limits the written workmanship or equipment warranties stated in your signed project agreement, or rights that cannot be disclaimed under applicable consumer law.

11. Limitation of liability & indemnity

To the fullest extent permitted by law: (a) Nu Home will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or goodwill, arising from or related to the site or these Terms; and (b) Nu Home's total aggregate liability arising from or related to the site or these Terms will not exceed the greater of one hundred dollars ($100) or the amount you paid Nu Home in the twelve (12) months before the claim. These limits do not apply to liability that cannot be limited by law, and do not limit remedies expressly provided in your signed project agreement.

You agree to indemnify and hold Nu Home harmless from claims arising out of your violation of these Terms, your content, or your violation of law or third-party rights, except to the extent caused by our own misconduct.

12. Dispute resolution — binding arbitration & class waiver

(a) Informal resolution first. Before filing any claim, you and we agree to try to resolve the dispute informally: send a written notice describing the dispute and the relief sought to support@nuhomeservice.com (or, for notices from us, to your email on file), and both sides will negotiate in good faith for 60 days, including at least one telephone conference if either side requests it. This step is a condition precedent to arbitration or any permitted court action, and any applicable limitations periods are tolled during it.

(b) Binding individual arbitration. Except as provided in (d), any dispute, claim, or controversy arising out of or relating to these Terms, the site, our marketing (including calls and texts), or our services — whether based in contract, tort, statute, or otherwise, and including disputes about the scope or enforceability of this section — will be resolved by final, binding arbitration on an individual basis, administered by the American Arbitration Association under its Consumer Arbitration Rules. The Federal Arbitration Act governs this agreement. The arbitrator may award the same individual relief a court could, and must apply these Terms as written. Judgment may be entered in any court of competent jurisdiction. Arbitration will occur in your county of residence or remotely by video, at your choice. If your claim is for $10,000 or less, we will pay arbitration filing, administration, and arbitrator fees beyond the amount of the court filing fee you would have paid; fees are otherwise allocated per AAA rules, and we will not seek our attorneys' fees from you unless the arbitrator finds your claim frivolous.

(c) Class action & jury waiver. You and Nu Home each waive the right to a jury trial and the right to participate in a class, collective, consolidated, or representative action, to the fullest extent permitted by law. The arbitrator may not consolidate claims or preside over any form of class proceeding. If this class waiver is found unenforceable as to a particular claim, that claim (and only that claim) shall proceed in court, with the balance remaining in arbitration. Claims for public injunctive relief that cannot be waived under applicable law may be pursued in court after arbitration of all arbitrable claims.

(d) Exceptions. Either party may (i) bring an individual claim in small-claims court, and (ii) seek temporary injunctive relief in court to protect intellectual property or confidential information pending arbitration.

(e) Mass filings. If 25 or more similar arbitration demands are filed by the same or coordinated counsel, the parties agree the AAA's Mass Arbitration Supplementary Rules apply: demands will be batched and resolved in staged proceedings, with bellwether arbitrations first and remaining demands tolled, so each claim receives individual treatment without duplicative fees.

(f) Your right to opt out. You may reject this arbitration agreement (except the jury-trial waiver) without penalty by emailing support@nuhomeservice.com with the subject “Arbitration opt-out” — including your name, address, and phone — within 30 days of first accepting these Terms. Opting out does not affect any other provision.

(g) Time limit. To the extent permitted by law, any claim must be filed within one (1) year after it accrues, or it is permanently barred.

13. Governing law & venue

These Terms are governed by the Federal Arbitration Act (for Section 12) and otherwise by the laws of the state where your project is performed — or, for website-only use, the State of Florida — without regard to conflict-of-law rules and without diminishing consumer protections you are entitled to under the law of your state of residence. For any action not subject to arbitration, you and we consent to exclusive jurisdiction and venue in the state or federal courts of the state whose law governs under this section.

14. General

If any provision is found unenforceable, it will be modified to the minimum extent necessary and the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a corporate transaction. These Terms, the Privacy Policy, and your signed project documents are the entire agreement about their subject matter. We may update these Terms by posting a revised version with a new “Last updated” date; material changes will be notified reasonably in advance, and continued use after the effective date is acceptance. Section 12 changes will not apply to disputes that arose before the change unless you accept them.
